Through the Office for Dispute Resolution, the Pennsylvania Department of Education (PDE) fulfills its statutory mandate to maintain a special education due process system. PDE contracts with the Central Susquehanna Intermediate Unit to provide fiscal and certain management support for that office, without becoming involved in substantive operations.

Introduction Pennsylvania, through the Office for Dispute Resolution (ODR), completed its second full year as a federally designated “exemplar state” in the area of special education dispute resolution. In February 2011, The Center for Appropriate Dispute Resolution in Special Education (CADRE) officially unveiled the Exemplar Initiative: Identifying, Profiling & Showcasing State Resources from High-Performing Special Education & Early Intervention Dispute Resolution Systems, of which Pennsylvania was one of four highlighted states. A Pennsylvania-specific Profile was also created; both documents are available on the CADRE website1. ODR representatives will be presenting the Pennsylvania Profile at CADRE’s national conference on dispute resolution in October 2011. Highlights from Fiscal Year 2010-11 include the following: Creating Agreement Training The Creating Agreement model is an OSEP-funded, innovative training program on conflict resolution, jointly developed by CADRE and the IDEA Partnership at the National Association of State Directors of Special Education (NASDSE), with input from a broad-based group of constituents. The vision underlying the creation of this training is the belief, supported by research, that educational outcomes are improved when families, schools and service providers work together collaboratively. Moreover, training and support for diverse groups of stakeholders facilitates shared learning and problem solving which in turn benefits the student learner. Pennsylvania, through ODR, was the original lead state in the country introducing this training to schools and parents. ODR continued to offer free Creating Agreement training during the fiscal year, and has now trained upwards of 2,500 stakeholders across the state in this conflict resolution model. Creating Agreement training was also presented to participants of “Include Me from the Start”, a PDE-funded project, whose goal is to support inclusive practices and collaborative partnerships between families and schools. Creating Agreement was introduced into a corrections education program, and continues to be a part of higher education outreach and training efforts. These collaborative efforts exemplify the broad applicability of Creating Agreement concepts to a myriad of diverse educational settings. Parent Engagement and Parent Collaboration ODR’s ConsultLine Supervisor continued her participation in a PDE-formed work group to address State Performance Plan Indicator 8 (Parent Engagement). Other group members included Parent Training Information Center (PTIC) representatives, Community Partners Resource Center (CPRC) staff, and PaTTAN Parent and Educational Consultants and Directors. Statewide training models were developed to support school districts in their endeavors to enhance parent involvement in schools. Each module included many activities developed by members of the Indicator 8 work group. These modules were presented to school district, intermediate unit personnel 1

and other interested individuals during roll-out sessions on October 15, 2010 and February 9, 2011. Outreach to Underserved Communities ConsultLine’s bilingual specialist continued Latino outreach efforts throughout the fiscal year, by participating in various events within or pertaining to the Latino community. Updating the comprehensive list of agencies and networks serving Spanish-speaking families was an ongoing effort during the year. ODR has continued to distribute its materials (in both English and Spanish) upon request from these agencies. A wealth of ODR materials was disseminated at the Hispanic HealthCare Summit in May 2011. Additional work took place on identifying a wider variety of potentially underserved populations in the state (including non-native English speakers, refugees and migrant workers) based on analysis of statistical data. Media Productions ODR has created, or is in the process of creating, video presentations on various special education topics: ODR/ConsultLine staff produced an English closed-captioned video about the IEP Facilitation process. The video is available on the ODR website; the Spanish closed-captioned version of this video is still in production. (http://odr-pa.org/iepfacilitation-video) An audio recording of the Procedural Safeguards Notice (PSN) was created to provide an alternative method for parents to access this information; it is available on the ODR website. (http://odr-pa.org/procedural-safeguards-notice) English and Spanish closed-captioned videos on Frequently Asked Questions about the Pennsylvania’s Procedural Safeguard Notice (PSN) are near completion. Summary of Activities and Data This report provides a summary of all ODR services and associated statistical data for Fiscal Year (FY) 2010-11, ending June 30, 2011. ConsultLine ODR’s ConsultLine is a toll-free helpline for parents and advocates with questions or concerns regarding the education of school-age children. ConsultLine is staffed by four specialists, one of whom is bilingual, who answer questions and provide information about special education, gifted education, and Section 504 of the Rehabilitation Act of 1973. Services provided by ConsultLine specialists include: • •
Describing the processes involved in having a student evaluated, identified, and provided with special education, accommodations, and related services; Explaining procedural safeguards;

• • •
Providing information about access to, and assistance with, the formal complaint processes of the Department of Education’s Bureau of Special Education (BSE); Discussing other opportunities to address concerns or disagreements about a student’s education; and Referring callers to other resources, including providing literature as needed.
Inquiries regarding children up to the age of five are handled by the Office of Child Development and Early Learning (OCDEL). When ConsultLine specialists receive such calls, ConsultLine’s scope of information is explained, and the caller is provided OCDEL’s contact information. Service to Callers Speaking Languages Other Than English ConsultLine has access to the services of Language Line, an interpretation service for parents who do not speak English as their primary language. Language Line can provide service in 170 languages. For calls with Spanish-speaking constituents, however, Language Line has not been needed, as ConsultLine’s bilingual Specialist was able to meet the needs of this population throughout the fiscal year. Caller Data In the 2010-11 fiscal year, ConsultLine received 3,513 incoming calls, providing service to 3,077 constituents. The difference between the number of calls received by ConsultLine and the number of callers receiving service is attributable to callers not being available to speak with the specialist who have made multiple attempts to return their calls. ConsultLine specialists may request, but do not require, that the caller identify his/her geographical region for statistical purposes. Because the number of calls attributable to a particular intermediate unit is dependent upon information volunteered by the caller, such data does not provide a complete depiction of statewide call distribution. Nonetheless, these statistics may afford a general impression of call activity throughout the commonwealth. Positive or negative inferences should not be drawn from the existence or absence of call activity within an intermediate unit. Based upon callerprovided information, ConsultLine received the majority of its calls from Philadelphia Intermediate Unit 26; Montgomery County Intermediate Unit 23; Capital Area Intermediate Unit 15; Allegheny Intermediate Unit 3; and Delaware County Intermediate Unit 25.2 (See Exhibit 1, ConsultLine Calls by IU and School District). All ConsultLine specialists identify and document the issues of concern addressed in each call. Three issues appeared most frequently in ConsultLine calls: IEP 2

implementation (190); educational placement (184); and the multidisciplinary evaluation process (155). In 152 calls, information was being requested, such as telephone numbers for agencies, questions falling outside of ConsultLine’s scope of assistance, etc. (See Exhibit 2, Issues Addressed in ConsultLine Calls). ConsultLine distributed materials to parents in 924 instances, a new offering this fiscal year being delivery by email.3 Caller Data for Gifted Education ConsultLine specialists handled 58 calls whose primary issue was gifted education. Call Resolution Process and Provision of BSE Complaint Packets ConsultLine’s Call Resolution Process (CRP) is a highly regarded and effective compliance-related dispute resolution tool created in conjunction with the Bureau of Special Education (BSE) for IDEA-related issues, as well as some issues related to Section 504 of the Rehabilitation Act of 1973. If, during the course of a call, the parent relays information suggestive of a possible compliance violation for which CRP might serve as a remedy, the specialist will explain CRP and offer it to the parent. CRP is voluntary, and instituted only upon express agreement by the parent of the student in question. The process consists of a ConsultLine specialist sending an email to the school’s special education director, as well as a copy of the email to the BSE Compliance Advisor assigned to the school district. The email will outline the parent’s description of the concern, and, as appropriate within the scope and limitations of the ConsultLine, what the parent would like as a remedy. When providing CRP, the ConsultLine specialist acts as a conduit of information between the caller and the school, but does not serve as an advocate, decision-maker, mediator, or compliance advisor. Once the email is sent, the specialist’s involvement in CRP has concluded. During FY 2010-11, CRP was offered in 311 instances, and provided in 126, after the parent’s agreement was confirmed. BSE complaint information packets and forms (complaint packets) are sent to the parent every time CRP is utilized, but also when otherwise requested by a caller, as indicated in call documentation. Complaint packets have always been sent by regular mail; however, as with all materials, delivery by email was made available this fiscal year as well. During FY 2010-11, specialists sent out 198 complaint packets. (See Exhibit 3, Complaint Packets Sent)

Call Resolution Process for Gifted Education When ConsultLine specialists assist callers who allege Chapter 16/Gifted Education compliance violations, they provide the caller with pertinent information regarding Chapter 16 regulations and procedural safeguards, including the availability of the option to file a written complaint. The caller is then referred directly to the BSE advisor designated for management of Chapter 16 compliance complaints. Caller Evaluations Typically, demographic information is only collected when the Specialist is mailing the caller publications, when CRP is conducted, or when a complaint packet or ODR form is being sent. To the extent demographic information is available, the Specialist will conclude service on a call by mailing to the caller an evaluation form regarding her service on the call. During this fiscal year, ConsultLine established an option for callers to receive materials electronically through e-mail. Along with this method of materials distribution, callers can respond online to a satisfaction survey which contains questions identical to those on the response cards. This electronic survey function allows the respondent to remain anonymous. ConsultLine received 109 evaluation forms during the fiscal year. Bilingual evaluation forms were sent to nine Spanish-speaking parents. As with past years, ConsultLine Specialists continue to receive high marks for their service: • • • • • • • • • • • •

IEP/IFSP Facilitation Third Party Facilitator When parent(s) and the school are having trouble communicating about a student's needs, Individualized Education Program/Individualized Family Service Plan (IEP/IFSP) facilitation is an option. Because IEP/IFSP facilitation is a voluntary process, both the parent(s) and the school must agree to the presence of a facilitator. A facilitator helps to create an atmosphere that allows all members of the IEP or IFSP team to participate and work together to develop an appropriate plan. The facilitator does not become a member of the IEP team, a decision maker, or a technical assistance consultant. Instead, the facilitator helps to clarify the points of agreement and disagreement, and ensures that the meeting stays focused on the needs of the student. The process assists the members of the team to create an IEP that will benefit the student. Facilitation Requests IEP Facilitation was requested 56 times during the fiscal year. Once again, districts in Montgomery County Intermediate Unit 23 requested IEP Facilitation most often. Of these 56 requests, the IEP was completed in 20 cases; in 22 cases a partial IEP was written as a result of the facilitated IEP process. There was just one instance where the parties were unable to reach whole or partial agreement using the services of a facilitator. In 11 instances, the request for facilitation was either withdrawn or denied by the non-requesting party, and two cases remained active at the close of the fiscal year and therefore those results are not included in this report. returned. Thirty-two respondents were very satisfied with the outcome of the IEP facilitation and 36 would recommend the process to others. Only two responded that the facilitator was not helpful. (See Exhibit 5, IEP Facilitation Evaluation Summary) Birth to Five (Facilitation Requests) There were no IFSP requests during the reporting period and five IEP facilitation requests for children ages 3-5. Of these five requests, there were two instances where the request for facilitation was withdrawn; one partial IEP was written and an IEP was completed in one case. There was one instance where the parties were unable to reach whole or partial agreement using the services of a facilitator. Mediation In FY 2010-11, ODR contracted with 23 independent contractors to provide mediation services to parents and educators. Because of the continuing trajectory of increased mediation requests again this year, ODR has contracted with five additional mediators to meet constituent needs for FY 2011-12. Mediation Training To fulfill contract obligations, mediators are required to attend annual trainings hosted by ODR. These trainings are intended to offer strategies to expand mediation skills as well as information to keep current and increase participant knowledge base on special education law, a requirement of IDEA. In the fall, Mediators attended the PBI Exceptional Children Conference, which offered a wide range of special educationrelated topics. In the spring, ODR hosted a two-day mandatory training. On Day 1, two trainers from the Public Conversations Project, Robert R. Stains, Jr., and Mary Jacksteit, presented "Mediating Beyond Impasse." The goals of this interactive training included: distinguishing a person-focused from a problem-focused stance; understanding the role and practice of preparation; recognizing reflective questions intended to serve the parties as opposed to the mediator; understanding personal triggers that could derail mediation; and engaging parties in empathetic ways. Day 2 of the training included information provided by the Special Education ConsultLine Specialists on special education law. This day also included a review of a Code of Ethics for Mediators, a document developed by the ODR Stakeholder Council, and also a discussion of practical applications of special education law within the context of mediation. Mediation Statistics ODR received the highest number of mediation requests (472) (as well as the concomitant lowest number of due process requests) than has been seen in more than a decade. See Figure 2.

Montgomery County Intermediate Unit 23 had the highest number of mediation requests (58), followed by Bucks County Intermediate Unit 22 (50); Chester County Intermediate Unit 24 (48); Allegheny County Intermediate Unit 3 (47); Delaware County Intermediate Unit 25 (40); Berks County Intermediate Unit 14 (29) and Philadelphia Intermediate Unit 26 (27). (See Exhibit 6, Mediation Requests and Results by Intermediate Unit and School District) Of the 472 mediation requests received by ODR, 277 were assigned to a mediator. The difference in number of requests versus number of assignments is due to withdrawal of the request after it is made, almost always due to settlement, but simply reported as a withdrawal (39); a reported settlement, or conciliation (57); no further response from one of the parties, usually attributable to settlement (43); or lack of consensus to use the mediation process (44). This means that only 9.3% of the total mediation requests received were initially denied by the parties; in 36 of the 44 instances, the LEA declined to participate in mediation. See Figure 3.

The mediators and parties achieved an overall agreement rate of 77.6%, when factoring in all categories of cases. The agreement rate for mediations involving students with disabilities was 78.3%. This percentage is within the range expected by OSEP. For reporting purposes to OSEP, ODR tracks those mediations that are related to due process. To define this relationship, ODR considers the mediation related to due process when the mediation request is received within 30 days of the due process request. For FY 2009-10, there were 89 mediations related to due process, an increase of 11 from the prior year. The results of those 89 due process hearings were as follows: eight ended in a hearing officer decision; five were dismissed by the hearing officer; 17 reached agreement during the resolution session; 24 reached agreement thereafter; 22 were withdrawn (most likely attributable to settlement, but reported as “withdrawn” by the constituent); and 13 were active at the close of the reporting period. The results of the 89 mediations were as follows: 13 reached an agreement; 11 were held but no agreement was reached; 13 were declined; 18 reached conciliation; 14 were withdrawn; 11 had no response from parties; and 9 were active at the close of the reporting period. The post-mediation evaluations indicate that a majority of participants were satisfied with the services of ODR and the mediators. Of significant note is that out of 339 responses returned to ODR, 337 responded that the mediator explained the mediation process and listened to their concerns. Only one respondent answered "no" to these questions. (See Exhibit 7, Mediation Evaluation Summary 7/1/2010 through 6/30/2011)

Birth to Five (Mediation Statistics) Of the total mediation requests, 40 were attributable to birth-five cases. In 20 instances, a mediation agreement was written. In only one instance, mediation was unsuccessful. Parties reached agreement on their own prior to the mediation in seven cases. Mediation was declined in four instances and withdrawn or otherwise settled in seven cases. In one instance there was no response from the parties. Gifted Education (Mediation Statistics) There were 18 mediation requests that pertained exclusively to Chapter 16/gifted education. Agreements were written in seven cases; in four instances no agreement was reached. Two agreements were reached prior to the mediation occurring; one request was withdrawn; in one instance there was no response from the parties; one request was declined, and as of this report, two remained active. Protected Handicapped/504 Students (Mediation Statistics) There were four requests pertaining to 504 issues. Of these, no mediations were held. Two resulted in agreement prior to mediation being held, one request was declined, and in one instance there was no response from the parties. Due Process Due Process Requests For FY 2010-11, ODR received 751 requests for due process, of which 722 pertained to children and students with disabilities with IDEA-related issues. Pennsylvania has not seen numbers this low since some time prior to 2000, a full decade (or more) ago. See Figure 4.

Sufficiency Challenges When a due process complaint is filed, the opposing party may challenge the sufficiency of the information contained within the complaint notice. In FY 2010-11, there were 52 sufficiency challenges, an increase from the prior year’s statistic of 43. In 29 instances, the complaint was amended in response to the sufficiency challenge; in eight instances, the hearing request was dismissed in its entirety as a result of the challenge. In the remaining 15 instances, the hearing officer determined that the complaint was sufficient as written, and the challenge was dismissed. Resolution Meetings Before moving forward to a due process hearing requested by the parent, the parties are obligated to hold a resolution meeting to try to reach agreement. This meeting must take place unless the parties agree to waive the meeting, or agree to pursue mediation instead. In many instances, the parties resolve the matter during the 30-day resolution period. The LEA is obligated to complete and return to ODR a detailed form about the resolution meeting during specified timeframes associated with different occurrences. The form is then provided to BSE for compliance monitoring. Complete statistical data was not yet available by the close of the fiscal year. This information will be provided in the Pennsylvania Annual Performance Report. As part of the ODR continuum for dispute resolution options, parties may choose to have a neutral facilitator attend the resolution meeting to assist the parties in reaching agreement on contested issues. During the reporting period, there were 49 requests for this voluntary process. Of these, 26 facilitated meetings took place. The results of the 26 facilitated resolution meetings are as follows: 15 reached agreement; four reached partial agreement; seven did not result in an agreement. Out of the 26 facilitated resolution meetings, 20 did not proceed to due process. Cancelled Requests Of the 751 requests for due process, 554 were cancelled prior to full adjudication (i.e., a hearing officer’s decision). In 27 instances, the hearing officer dismissed the request. As to the balance, when a party requests withdrawal of a pending due process matter, the reason for the request is not always provided. To maintain the integrity of the data collected, ODR documents the precise reason given by the litigant. It is believed that the majority of withdrawals are due to settlement, although not necessarily reported this way. The cancelled request breakdown is as follows: Parties reached agreement (322); Resolution Agreements (115); and Withdrawals (90). The balance of cases was still 13

Hearing Officers There are six full-time hearing officer positions, and three contracted hearing officers. One of the contracted hearing officers handles gifted education cases only; the other two contracted hearing officers handle any conflict cases. Hearing Officer Training ODR strives to provide a wealth of training opportunities to ensure that the hearing officers stay current on special education issues. During the past fiscal year, the hearing officers attended the Administrative Law Judges (ALJ) annual seminar; National Autism Conference at Penn State; National Association of Hearing Officials (NAHO) 2010 Annual Professional Development Conference; PBI Exceptional Children Conference; PDE Annual Conference; LRP Special Education School Attorneys Conference; Council of Parent Attorneys and Advocates (COPAA) Conference; Lehigh University 39th Special Education Law Conference; and the Lehigh University's Special Education Law Symposium. Dr. Linda Valentini is now a certified hearing official through NAHO. The remaining hearing officers continue to take the necessary courses and trainings to become certified hearing officials. Timelines For parent-initiated due process hearings, the law provides for an initial 30-day resolution period, followed by a 45 day period (30+45=75) to conduct the hearing session(s). LEA-initiated due process hearings are to be completed during a 45-day

period. Hearing officers have the authority to grant extensions of the 45-day timeline, upon request of a party. Typically, the reasons given for an extension include parties working towards an agreement; scheduling conflicts; and awaiting the completion of evaluations. A case is considered to be fully adjudicated if the hearing officer issues a final decision. Most cases are not fully adjudicated; they are settled prior to the completion of the case. Non-adjudicated cases remained active an average of 53 days before the parties settled. See Figure 8. Birth to Five (Issues) IEPs and compensatory education were the predominant issues in Birth-5 cases. Gifted Education (Issues) Placement, compensatory education, and eligibility were the predominant issues in gifted cases. Hearing Officer Decisions Sixty-seven decisions were written for FY 2010-11 requests: 64 pertained to IDEA; one pertained to Chapter 15/Section 504; and two pertained to gifted education. The hearing officer supported the parent, in whole or in part, in 21 instances. In 34 instances, the hearing officer supported the school district, in whole or in part. In the remaining 12 cases, the hearing officer wrote a decision supporting parent in part, and school district in part, or the hearing officer issued his/her own decision. See Figure 11.

Birth to 5 (Hearing Officer Decisions) There were no Birth to 5 hearing officer decisions. Chapter 15/Section 504 (Hearing Officer Decisions) The Chapter 15/Section 504 requests resulted in one decision which supported the parent. Gifted Education (Hearing Officer Decisions) The gifted education requests resulted in two decisions: one supported the parent and the other supported the agency. Due Process Evaluations During the reporting period, ODR received only 8 evaluations of the due process system, six from administrators, one from a school attorney and one from a parent. The Due Process Evaluations are now available on the ODR website for online submission. Appeals Appeals to State and Federal Court There were 34 certified records transmitted to state or federal court during the reporting period. Of those 34, three were for due process hearings requested and completed during the fiscal year. The appeals were filed by the LEA. As of the close of the reporting period, one case was still in progress and two cases were dismissed.

Costs Contractors IEP Facilitators billed a total of $21,894.05 for services rendered during the fiscal year. (See Exhibit 10, IEP Facilitators’ Fees by LEA) Mediators billed a total of $113,373.67 for services rendered during the fiscal year. (See Exhibit 11, Mediators’ Fees by LEA) Resolution Session Facilitators billed a total of $13,017.31 for services rendered during the fiscal year. (See Exhibit 12, Resolution Session Facilitators’ Fees by LEA) Court Reporting Fees Court Reporting fees for FY 2010-11 were $504,785.52 with one-third billed to the respective LEA ($168,261.84).
